1. Who we are

This privacy notice is issued by Blue41 NV, Borsbeeksebrug 34, 2600 Antwerpen, Belgium, enterprise number BE 1035.644.947 (“Blue41”, “we”, “us”).

It explains how we process personal data of website visitors, of people who contact us or apply for a job, and of contacts at customers, prospects, partners and suppliers. We do so as controller, in accordance with the GDPR and Belgian data protection law.

Our Privacy Lead handles all privacy questions and requests at [email protected].

2. What we collect

  • Through our website forms: your email address and, if you choose to provide them, your name, organisation and a description of your use case or message. We also record which page of our website you came from and when you first contacted us.
  • When you apply for a job: your application and CV, sent to [email protected] or through LinkedIn.
  • In our business relationship: the information you share when you correspond, meet or contract with us.
  • Automatically: when you visit our website, technical data such as your IP address, browser and the pages you view. We use this to deliver and secure the website, to count visits, and to see which organisations visit our website, based on the IP address of their network.

3. Why we use it

We use your data to:

  • answer your request, send you the document you asked for, or add you to a waiting list (legitimate interest, or steps you asked us to take before a contract)
  • follow up with organisations that showed interest in our platform (legitimate interest in promoting our platform to businesses)
  • enter into and perform contracts, including support (legitimate interest in performing our contract with your organisation)
  • invoice and keep accounts (legal obligation)
  • operate, secure and measure the use of our website, and see which organisations visit it (legitimate interest in a secure and well-functioning website and in understanding business interest in our platform)
  • handle job applications (steps prior to an employment contract) and keep your application for future vacancies (legitimate interest in recruiting suitable candidates)

Every follow-up email lets you opt out. We do not sell your data, and we do not use it for automated decision-making.

4. Who we share it with

We share personal data only with service providers that act on our behalf under a data processing agreement, such as providers of website hosting and analytics, customer relationship management, email outreach, form handling, email and document storage, and issue tracking. We also share it with our accountant and legal counsel, and with authorities where the law requires it. You can request the list of our service providers at [email protected].

Transfers to providers outside the European Economic Area are protected by an adequacy decision or the Standard Contractual Clauses of the European Commission, a copy of which you can request at [email protected].

5. How long we keep it

We keep personal data only as long as we need it for the purpose for which we collected it:

  • contact and prospect data: at most 2 years after our last interaction, or until you object or ask us to delete it
  • job applications: at most 2 years after the recruitment procedure, so we can contact you about future vacancies, unless you ask us not to
  • contacts at customers, partners and suppliers: for the duration of the business relationship and the limitation period for contractual claims under Belgian law
  • contracts and accounting records: for the period required by Belgian accounting and tax law

After that, we delete or anonymise the data.

6. Your rights

You can ask to access, correct or erase your data, restrict or object to its processing, and receive it in a portable format. You can object to direct marketing and withdraw consent at any time. Email [email protected]; we respond within one month, free of charge.

You can also lodge a complaint with the Belgian Data Protection Authority (Drukpersstraat 35, 1000 Brussel, [email protected], www.dataprotectionauthority.be).

7. Cookies

We do not use cookies for analytics or advertising. We measure visits with an analytics tool that does not use cookies.

8. Data processed for our customers

This notice does not cover data processed through the Blue41 platform or in the services we provide to customers. When a customer runs the platform in its own environment, Blue41 does not receive that data. When we operate the platform for a customer (SaaS) or provide services that involve the customer’s data, we process that data as processor on the customer’s instructions, and the customer’s privacy notice applies. If you contact us about such data, we forward your request to the customer.

9. Changes and questions

We update this notice when our processing changes; the date at the top shows the latest version. Questions? Contact [email protected] or write to Blue41 NV, Borsbeeksebrug 34, 2600 Antwerpen, Belgium.
